The government at all levels, local, state and national, is moving to criminalize all behavior. Criminal intent is no longer necessary. I have written a lot about this previously. Our rational Supreme Court Justices like Scalia see this problem, but liberals like the idea of discretionary power so they can criminalize their opponents.
