Elana Kagan refused to speculate on where the Commerce Clause could not be used by Congress to pass laws controllling the activities of citizens. It is time for a Constitutional Amendment that spells out the limitations on the Commerce Clause because it currently can be used to justify anything Congress wants to pass.
